(1) The division shall adopt administrative rules in accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, in consultation with hospital pharmacies and the boards of practitioners authorized to prescribe prescription drugs to establish guidelines under which a practitioner may dispense prescription drugs to a patient in a hospital emergency department if: (a) the hospital pharmacy is closed; (b) in the professional judgment of the practitioner, dispensing the drug is necessary for the patient's immediate needs; and (c) dispensing the prescription drug meets protocols established by the hospital pharmacy.
