§ 46-14-8. Penalties. (a) Civil penalty. Any person who violates the provisions of this chapter, or any rule, regulation, or order issued pursuant thereto, shall be subject to a civil penalty of not more than five thousand dollars ($5,000) for each day during which the violation occurs.

(b) Criminal penalty. (1) Any person who shall be found guilty of violating, willfully or with criminal negligence, any of the provisions of this chapter, or of any rule, or regulation issued pursuant thereto, or an order of the director, shall be punished by a fine of not more than five thousand dollars ($5,000) or by imprisonment for not more than thirty (30) days, or by both such fine and imprisonment, and every person shall be deemed guilty of a separate and distinct offense for each day during which the violation shall be repeated or continued.

(2) Any person who knowingly makes any false statement, representation, or certification in any application, record, report, plan, or other document filed or required to be maintained under this chapter or by any rule, regulation, or order issued under this chapter or who falsifies, tampers with, or knowingly renders inaccurate any monitoring device or method required to be maintained under this chapter, or by any permit, rule, regulation, or order issued under this chapter, shall, upon conviction, be punished by a fine of not more than five thousand dollars ($5,000) for each instance of violation or by imprisonment for not more than thirty (30) days, or by both such fine and imprisonment.
