§ 42-66.2-8. Penalties. (a) Criminal penalties. Any person who submits a false or fraudulent claim under this chapter, or who aids or abets another in the submission of a false or fraudulent claim, or who is eligible under a private, state, or federal program for prescription assistance and who claims or receives duplicative benefits hereunder or who otherwise violates any provisions of this chapter is deemed guilty of a misdemeanor and is subject to imprisonment for a term of not more than one year or a fine of not less than five hundred dollars ($500), or both.
(b) Any provider or consumer found guilty of intentionally violating the provisions of this chapter shall be subject to immediate termination from this program for a period of no less than one year.
(c) Repayment of gain. Any provider or consumer who is found guilty under this chapter is subject to repay three (3) times the value of the material gain he or she received.
