En toda elección general se diseñarán tres (3) papeletas de color de fondo diferente, una de las cuales incluirá bajo la insignia del partido político correspondiente a sus candidatos a gobernador y a comisionado residente; otra incluirá bajo la insignia del partido político correspondiente a los candidatos a legisladores; y otra donde bajo la insignia del partido político correspondiente se incluirá el nombre de los candidatos a alcalde y legisladores municipales. Esta deberá estar diseñada de manera que el elector tenga total control de la misma hasta el momento en que la registre y grabe su voto en un dispositivo de votación o escrutinio electrónico mediante su interacción directa con la máquina de votación o escrutinio electrónico. Las instrucciones serán impresas en los idiomas español e inglés.

Sujeto a lo dispuesto en este subtítulo, la Comisión determinará mediante reglamento, el diseño y texto que deberán contener las papeletas a usarse en cada elección.

En cada papeleta se imprimirán, en inglés y español, respectivamente, instrucciones sobre la forma de votar. El texto de las instrucciones en ingles será el siguiente, acorde con la papeleta de que se trate:

On this ballot you have the right to vote for one candidate for Governor and one candidate for Resident Commissioner.

HOW TO CAST A STRAIGHT-PARTY VOTE

In order to vote for straight-party, place a single valid mark in the blank space under the emblem for your party of preference and make no other markings on the ballot.

HOW TO CAST A SPLIT-TICKET (SPLIT BALLOT) VOTE

To cast a split ticket vote, place a valid “mark” next to a candidate or a combination of candidates outside of your party’s column, or write-in the name or another person of your preference for the appropriate office using the last column for Direct-Nomination Votes. On this ballot you have the right to vote for one candidate for Mayor and the exact number of Municipal Legislators shown on one of the columns. If you vote for more than one Mayoral candidate or more than the number of Municipal Legislators you are entitled to elect, you will nullify your vote for those offices.

HOW TO CAST A STRAIGHT-PARTY VOTE

In order to vote for a straight party, place a single valid “mark” in the blank space under the emblem for your party of preference and make no other markings on the ballot. This single “mark” will be valid for the Mayoral candidate and all Municipal Legislature candidates under that emblem.

On this ballot you have the right to vote for only five (5) legislative candidates, as follows: one (1) single candidate for District Representative; two (2) candidates for District Senator; one (1) single candidate for Representative At-Large; one (1) single candidate for Senator At-Large.

HOW TO CAST A STRAIGHT-PARTY VOTE

In order to vote for a single party, place a single valid “mark” in the blank space under the emblem for your party of preference and make no other markings on the ballot. This single “mark” will be valid for all five legislative candidates you are entitled to vote for on this ballot. For Representative and Senator At-Large positions, only the candidate in the first position on the ballot under the party emblem for which you have voted will get the single-party vote for the precinct: the Representative in position No. 4 and the Senator in position No. 10.

HOW TO CAST A SPLIT-TICKET (SPLIT BALLOT) VOTE

To cast a split-ticket vote, place a valid “mark” under the emblem for your party of preference and place a “mark” next to one or more candidates outside of your party’s column, or write in the name of another person of your preference using the last column for Direct Nomination Votes. Bear in mind that you may not vote for more candidates than those stated earlier. (No more than one District Representative; no more than two District Senators; no more than one Representative At-Large; no more than one Senator At-Large). This also becomes a mixed vote ballot when you place a marking for another Representative or Senator At-Large candidate in the same column for the party, under which you voted, that may be different from the one shown on position # 4 or position # 10. When casting a mixed vote, the vote you give to another candidate is lost to the candidate for that same position under the party emblem for which you voted.

HOW TO VOTE FOR INDIVIDUAL CANDIDATES

When a voter has no interest in voting for a particular party and wants to vote exclusively for one or more candidates, the voter must place a valid “mark” next to the candidates of his or her preference, or may write the name(s) of other persons of the voter’s preference not listed as candidates, under the appropriate position title in the Direct Nomination column.

HOW TO VOTE FOR INDEPENDENT CANDIDATES

A voter interested in voting exclusively for an independent candidate may place a single “mark” or valid marking inside the blank square titled “Independent Candidates” and that single marking will count for all independent candidates in said column.

El texto de las papeletas será en negro y en caso de que para que el elector vote mediante marcas escritas sean impresas en papel o cualquier otro material, el material será opaco y el espesor del mismo será uniforme y grueso de manera que lo impreso en ellas no se trasluzca al dorso.

La insignia de cada partido político se presentará en la parte superior de la columna correspondiente con un espacio suficiente para que el elector pueda hacer su marca bajo dicha insignia, y bajo ella, inmediatamente después, la lista de los candidatos, así como los cargos para los cuales hubieren sido designados. Cuando hubiere dos o más cargos del mismo título, éste aparecerá una sola vez sobre la lista de candidatos para dicho cargo. Los nombres de los candidatos se colocarán a una distancia uniforme entre sí que permita su impresión legible y teniendo el nombre de cada candidato a su izquierda, un número y espacio suficiente apropiado para cualquier marca válida. El nombre en la papeleta deberá siempre incluir al menos uno de los nombres de pila y uno de los apellidos legales del candidato o la candidata.

La papeleta para legisladores llevará, como mínimo, la insignia de cada partido político presentada en la parte superior de la columna correspondiente con espacio suficiente para que el elector haga su marca bajo dicha insignia, y bajo ella, aparecerá una raya gruesa, e inmediatamente debajo, se colocará en primer término el nombre del candidato para representante por distrito y debajo, separados por otra raya gruesa, los nombres de los candidatos para senadores por distrito. Inmediatamente debajo, separados por otra raya gruesa, se colocarán los nombres de los candidatos para representantes por acumulación, y debajo, separados por otra raya gruesa, los nombres de los candidatos para senadores por acumulación. La Comisión ordenará la impresión de los nombres de senadores y representantes por acumulación en el mismo orden en que fueren certificados para cada municipio o precinto por el organismo directivo central del partido político con derecho a nominar candidatos.

Cada papeleta contendrá, además, una columna con el título de nominación directa, sin insignia alguna, que contendrá al igual que las demás columnas correspondientes a los partidos políticos, los títulos de los cargos que hayan de votarse en la elección y debajo de dichos títulos, en vez de los nombres de los candidatos, tantas líneas en blanco como candidatos hayan de votarse para cada clase de cargo. El elector que deseare votar por candidatos que no figuren en las columnas de los partidos políticos o como candidatos independientes, podrá hacerlo, escribiendo el nombre o nombres de ellos en la columna para nominación directa en el lugar correspondiente y podrá también dar voto a otros candidatos que figuren en otros espacios de la papeleta haciendo una marca en el espacio de cada uno de dichos candidatos, siempre que no fuere incompatibles con los que hubiere votado en la columna correspondiente a nominación directa.

La comisión especial dispondrá mediante reglamento el diseño y contenido de las papeletas a utilizarse en los casos de una elección especial en la cual un partido político presente más de un candidato para cubrir una vacante de un cargo público electivo de un funcionario que fue electo en representación de dicho partido político.

Por otro lado, en casos de una elección especial en la cual se cubrirá una vacante a un cargo público electivo de un funcionario que fue electo como candidato independiente o en representación de un partido político que no presenta candidato alguno para cubrir dicha vacante dentro del término establecido por este subtítulo, el diseño y contenido de las papeletas a utilizarse en esta elección especial será establecido por la Comisión mediante reglamento.
