A. A pharmacy benefits manager shall not charge a pharmacy a fee related to the adjudication of a claim, including:
(1) the receipt and processing of a pharmacy claim;
(2) the development or management of a claim processing or adjudication network; or
(3) participation in a claim processing or claim adjudication network.
B. A pharmacy benefits manager shall not charge a pharmacy a fee for a service unless the fee for service is itemized in the pharmacy benefits management contract.

The 2019 amendment, effective July 1, 2019, provided that a pharmacy benefits manager shall not charge a pharmacy fee for a service unless the fee for service is itemized in the pharmacy benefits management contract; added new subsection designation "A." and redesignated former Subsections A through C as Paragraphs A(1) through A(3); and added new Subsection B.
Applicability. — Laws 2017, ch. 16, § 3 provided that the provisions of Laws 2017, ch. 16, § 2 apply to any contract executed or renewed on or after June 16, 2017 and shall not be construed to affect the terms of a contract entered into or renewed before June 16, 2017.
