1. Except as otherwise provided in subsection 2, crankcase drainings, lube-distillate, or any other petroleum product may not be sold, offered for sale, delivered, offered for delivery or stored as a motor oil or lubricating oil for use in the crankcase of an internal combustion engine unless it conforms to the performance rating set forth on its container or, in the case of a bulk delivery, on the delivery receipt, and the following specifications:

(a) It must meet the specifications for engine oil performance and engine service classification set by SAE International.

(b) It must be free from water and suspended matter when tested in accordance with the procedures approved by the State Sealer of Consumer Equitability.

(c) The flash points for the various viscosity grade classifications must not be less than the most recent viscosity grade classifications determined by SAE International when tested by the Pensky-Martens Closed Cup method. The viscosity grade classification number of motor or lubricating oils must conform to the latest viscosity grade classification determined by SAE International.

2. The provisions of this section do not apply to any oil labeled “prediluted” or intended only for mixture with gasoline or other motor fuel in a two-cycle engine.
