Section 324.11513 Acceptance of Solid Waste or Municipal Solid Waste Incinerator Ash for Disposal; Applicability of Subsection (1) to Coal Ash; Enforcement.

Sec. 11513.

(1) A person shall not accept for disposal solid waste or municipal solid waste incinerator ash that is not generated in the county in which the disposal area is located unless the acceptance of solid waste or municipal solid waste incinerator ash that is not generated in the county is explicitly authorized in the approved county solid waste management plan.

(2) Subsection (1) does not apply to coal ash that is accepted for disposal at a captive facility that, after the effective date of the amendatory act that added this subsection, accepts only nonhazardous industrial waste generated only by the owner of the landfill or coal ash impoundment or its corporate affiliates.

(3) The department shall take action to enforce this section within 30 days of obtaining knowledge of a violation of this section.
