76.085 Privately constructed sewers to be approved -- Investigation, charges. (1) Any person or corporation, public or private, in the county in which such district is located submitting for approval plans and designs of sanitary sewers or storm water drainage facilities, or both, to be constructed by such person or corporation, private or public, pursuant to KRS 76.080 shall file with the district a written application for such approval or other action upon the plans and designs submitted by such person or corporation. (2) When the district receives an application for approval of plans or designs of sanitary sewers and/or storm water drainage facilities to be constructed by some individual or corporation, the metropolitan sewer district is authorized and empowered to examine, inspect and investigate, as seems to be advisable, the sufficiency of the facilities which the application seeks to construct, to serve the purposes intended, and to establish and make reasonable charges for such services on the basis of a schedule adjusted according to the services required to make such investigation or on any other reasonable method. (3) When it appears to the district that the construction of any sanitary sewer and/or storm water drainage facility being made by any other individual or corporation, requires inspection and supervision in order to assure the protection of public health and the proper subsequent completion of such facility for the purposes intended, the metropolitan sewer district shall include such finding in its order approving, modifying or disapproving the particular plans and projects, and shall charge such person or corporation for such inspection and supervision on the basis of the actual cost of inspection plus a reasonable additional cost of supervision.
