367.550 Termination of service contract by military service member. (1) Any person who enters military service or a member of the Armed Forces of the United States, Reserves, or National Guard, after receiving official orders to relocate for a period of service of no less than ninety (90) days, may terminate or suspend, without penalty or fee, any of the following contracts for services: (a) Internet; (b) Television and cable; (c) Athletic club or gym memberships; and (d) Satellite radio. (2) Termination or suspension of a contract under this section shall be made by delivery of a written or electronic notice to the specified service provider with a copy of the service member's official military orders. (3) A termination or suspension under this section shall be effective on the day notice is given under subsection (2) of this section. (4) A service member who terminates or suspends a contract for services under the provisions of this section may reinstate the provisions of services upon providing written or electronic notice to the service provider that he or she is no longer on active military service. (5) Nothing in this section shall be construed to conflict with the provisions of the federal Servicemembers Civil Relief Act, 50 U.S.C. secs. 3901 et seq. (6) Nothing in this section shall be construed to excuse or limit the liability of the service member of an outstanding balance due to the service provider. (7) The provisions of this section shall only apply to contracts entered into on and after June 27, 2019. Effective: June 27, 2019 History: Created 2019 Ky.
