§ 27-101-405. Marine Sanitation Advisory Committee

(a) There is established a Marine Sanitation Advisory Committee, to consist of seven (7) members appointed by the Governor as follows:

(1) Four (4) members shall be marina operators;

(2) Two (2) members from the state at large to be appointed by the Governor after consulting with the Director of the Department of Health and the Director of the Arkansas Department of Environmental Quality; and

(3) One (1) member shall be a boat owner.

(b)

(1) The two (2) members appointed pursuant to subdivision (a)(2) of this section shall serve at the pleasure of the Governor.

(2) Of the initial members appointed under subdivisions (a)(1) and (a)(3) of this section, two (2) shall be appointed for one-year terms, two (2) for two-year terms, and two (2) for three-year terms.

(3) Members shall serve three-year terms except that persons appointed to fill vacancies resulting in an unexpired term shall serve for the remainder of that unexpired term.

(c) Upon recommendation of the advisory committee made after notice and hearing, the Governor may remove any member of the advisory committee for incompetence, neglect of duty, or malfeasance in office.

(d) Any vacancy on the advisory committee shall be filled by the Governor.

(e)

(1) The Governor shall call the first advisory committee meeting.

(2)

(A) The advisory committee shall elect annually from its membership a chair, a vice chair, and a secretary.

(B) The chair shall not serve more than two (2) consecutive terms as chair.

(3) The advisory committee shall meet as frequently as it deems necessary at such times and places as the advisory committee designates. Additional meetings may be held upon the call of the chair or upon written request of three (3) members of the advisory committee.

(f) Four (4) members of the advisory committee shall constitute a quorum.

(g) The members of the advisory committee shall not be entitled to compensation for their services.

(h) Members appointed under subdivision (a)(2) of this section shall be appointed by the Governor subject to confirmation by the Senate.
