A fiduciary shall not take this assessment from the ward's or protected person's estate if the ward or protected person is eligible for supplemental security income benefits or would be eligible for these benefits if that person were not in a public institution.

B. The public fiduciary shall pay all funds received pursuant to this section to the county treasurer for deposit in the county general fund.
