The Secretary may deny a waiver request if:
For a Title-I-eligible program, the requested waiver is prohibited by Federal law; or
For a non-Title-I-eligible program, the requested waiver is:
Prohibited by Federal law; or
Inconsistent with the express provisions of the AFA.
