The requirements of section 3 apply to all public employees to the greatest extent consistent with constitutionally allocated powers.
History: 2011, Act 297, Imd. Eff. Dec. 22, 2011 Constitutionality: The court in Bassett v Snyder, 59 F Supp 3d 837 (ED Mich, 2014), held that sections 3 and 4 of the public employee domestic partner benefit restriction act, 2011 PA 297, MCL 15.583 and 15.584, violated the Equal Protection Clause of the United States Constitution. The court granted a permanent injunction against enforcing the act.
