§6303. Death of mortgagor or successor

If a person entitled to redeem a mortgaged estate or an equity of redemption that has been sold on execution, or the right to redeem such right, or the right to redeem lands set off on execution, dies without having made a tender for that purpose, a tender may be made and an action for redemption commenced and prosecuted by the person's personal representative, or by the person's heirs or devisees subject to the authority of the personal representative over the administration of the estate under Title 18-C, sections 3-709 and 3-711. If the plaintiff in such action dies pending the action, it may be prosecuted to final judgment by the plaintiff's personal representative, or by the plaintiff's heirs or devisees subject to the same authority of the personal representative. When a mortgagor resides out of the State, any person may, in the mortgagor's behalf, tender to the holder of the mortgage the amount due thereon.
