The provisions of sections 40-9-101 to 40-9-108 shall apply to any person who is held to be a common carrier within the meaning and purpose of said sections and to any common carrier engaged in the transportation of passengers or property by railroad from one point within the state to any other point within the state. These sections shall not apply to the ownership or operation of street transportation public utilities conducted solely as common carriers in the transportation of passengers.
