•Defense of Traffic Ticket Violations. The Member has the right to receive a defense from the Provider Law Firm in the court of original jurisdiction (the trial court) when (1) the Member is doing Ride-Share & Delivery Work; (2) the Member is driving a Ride-Share & Delivery Vehicle; and (3) the Member is issued a noncriminal moving traffic ticket or citation for a violation arising from the Member’s operation of the Ride-Share & Delivery Vehicle. This benefit is limited to up to two hours of attorney and legal assistant time spent in the negotiation and documentation of a deferred adjudication, plea agreement, probation, diversion, or other pretrial resolution that does not require an in-person appearance by the Provider Law Firm in court or in the prosecutor's office. To be eligible for Services related to moving traffic tickets or citations, the Member must request a consultation with the Provider Law Firm within three business days of receiving the ticket or citation. Traffic tickets or citations must be uploaded to the LegalFix Site and accessible to the Provider Law Firm within five business days of the Member receiving the ticket or citation.
•Defense of Vehicular Manslaughter or Homicide Charges. The Member has the right to receive a defense from the Provider Law Firm in the court of original jurisdiction (the trial court) when (1) the Member is doing Ride-Share & Delivery Work; (2) the Member is driving a Ride-Share & Delivery Vehicle; and (3) the Member is charged with manslaughter, involuntary manslaughter, negligent homicide, vehicular homicide, or other death-related criminal charges arising from the Member’s operation of the Ride-Share & Delivery Vehicle.
•Property Damage Claims. A Member has the right to receive legal assistance from the Provider Law Firm in the form of phone consultation, legal research, and document review related to claims and recovery of property damage to their Ride-Share & Delivery Vehicle. The benefit does not include assistance with the filing of a lawsuit or representation in a lawsuit; does not include claims or recovery for personal injury damages; is limited to a maximum of 2.5 hours of Provider Law Firm time per property damage occurrence; and is limited to occurrences in which the property damage does not exceed $5,000.
•The Provider Law Firm may advise and consult with the Member regarding a potential lawsuit to recover for additional property damage (in excess of $5,000) to their Ride-Share & Delivery Vehicle—and to recover for personal injury damages, for example—but such Services only qualify for the 25% discount benefit if the Member and the Provider Law Firm sign a written attorney-client contract for hourly legal services, including the Member’s payment of any retainer or fee deposit required by the Provider Law Firm.
•Out-of-plan legal services for recovering property damages and personal injury damages that are not covered by the Supplement—such as recovery of property damage losses greater than $5,000, recovery of personal injury damages, and the filing of a lawsuit—are not eligible for the 25% discount if the Provider Law Firm accepts representation on a contingent fee/contingency fee basis (attorney fee taken as a percentage of the amount recovered) or a flat fee basis. Unless the attorney fee agreed to by the Member and the Provider Law Firm for such legal services is strictly an hourly fee with a retainer or fee deposit, the decision to provide a discount on out-of-plan legal services must be negotiated by the Member and the Provider Law Firm and the Provider Law Firm is under no obligation to provide any discount.
