The Member may receive phone consultations from the Provider Law Firm during regular, non-holiday office hours on an unlimited number of legal matters related to the Member’s HOA Membership—including preexisting conditions. Consultations are available to the extent the Provider Law Firm determines it is necessary to adequately advise the Member on the legal matter. One phone consultation per HOA Membership subject/situation—up to 30 minutes per call.

For a flat fee of $250, the Provider Law Firm will review and provide an initial round of feedback on each of 4 types of HOA Governing Documents (with feedback provided in writing or by phone call of up to 30 minutes): (1) Articles of Incorporation; (2) Declaration of Covenants, Conditions, and Restrictions (CC&Rs); (3) Bylaws; and (4) Rules & Regulations (HOA Governing Documents). Each HOA governing document reviewed by the Provider Law Firm must be a current governing document or proposed governing document for an HOA in which the Member is a member or is considering becoming a member. Each such HOA governing document may be up to 100 pages in length, and the Provider Law Firm will review 1 of each of these 4 types of HOA governing documents per Membership Year. The flat fee of $250 includes the review of all 4 documents.

The Provider Law Firm will review and provide an initial round of feedback on up to 5 HOA meeting and voting documents per Membership Year, including HOA Annual Meeting Notices, Special Meeting Notices, and Absentee Ballots—with feedback provided in writing or by phone call of up to 30 minutes.

A provider attorney will review a Member-homeowner's insurance policy in connection with a potential claim for a covered loss suffered by the Member-homeowner or a covered liability claim against the Member-homeowner; advise on coverage; and help submit a loss claim or a demand to defend and indemnify the insured Member-homeowner—up to 3 claims per Membership Year.

If the Member is a named defendant in a Covered Lawsuit (as defined in the Benefits Overview), the Member may receive an additional 105 hours of trial defense against HOA-related civil liability claims related to the interpretation or enforcement of the Member’s obligations under the HOA Governing Documents: 75 hours of Trial Time, 25 hours of Pretrial Time, and 5 hours of research, with each year of membership. This additional 105 hours is in addition to the Trial Defense Services provided under the Individual & Family Legal Plan Contract. These additional hours of Trial Defense Services and the total Trial Defense Services under the Individual & Family Legal Plan Contract and this Supplement are shown on the Schedule of Hours in the Benefits Overview. A Covered Lawsuit is a civil lawsuit against the Member related to the interpretation or enforcement of the Member’s obligations under the HOA Governing Documents when the lawsuit is not initiated by the Member and is filed in a state or federal court, or in an arbitration proceeding that is not initiated by the Member and that is filed in accordance with the HOA Governing Documents. Pretrial Time is defined as time spent by the Provider Law Firm in defense of a Covered Lawsuit prior to the date of jury selection—or, if it’s a nonjury trial, time spent prior to the date of opening statements. For example, Pretrial Time includes phone calls, mediations, settlement conferences, pretrial scheduling conferences with the judge or a court or arbitration administrator, discovery (written discovery, depositions), and preparation of pleadings, and briefs—including motions for summary judgment or other early dismissal. Trial Time is defined as time spent by the Provider Law Firm in defense of a Covered Lawsuit, beginning on the date of jury selection—or, if it’s a nonjury trial, beginning on the date of opening statements—and ending on the date of the jury verdict, bench decision (by the judge), or other conclusion of the trial. Trial Time is limited to 8 hours per day and may include Provider Law Firm time both in and out of the courtroom. The hours are available to use on all civil actions filed during a Membership Year. If more than one civil action is filed against a Member or the Member’s Spouse in a Membership Year, the unused hours remaining at the conclusion of each civil action may be used for any later civil action. Hours that are not used during the Membership Year expire and do not roll over to any later Membership Year. The Member must continue their membership while any civil action is pending to receive the Trial Defense Services.

The Member has the right to receive a 25% Discount off the Provider Law Firm's standard hourly rate for attorney fees on out-of-plan legal services (not covered by this Supplement) related to the Member’s HOA Membership. The 25% Discount is available during the Eligibility Period unless this Supplement explicitly states that it is not available. The 25% Discount is not available for contingent fee/contingency fee matters or flat fee arrangements, which may be negotiated at a separate rate with the Provider Law Firm. The Member is responsible for paying court costs, fines, and related fees and expenses. Depending on the Member's legal needs, a retainer fee or fee deposit may be required by the Provider Law Firm prior to services being rendered under the 25% Discount. The Provider Law Firm is responsible for determining the amount of the retainer fee or fee deposit and any other anticipated costs.
