Firearms are powerful and useful tools when used properly—as a form of self-defense to protect you and your family from home invasion or other potential threats of deadly force; for hunting animals for food, sport, or population control; and for skeet shooting and target practice for sport or competition.

And of course, the right of U.S. citizens to keep and bear arms has been protected by the U.S. Constitution since the Second Amendment to the Constitution was passed by the U.S. Congress as part of the Bill of Rights in 1791.

But owning firearms for self-defense, hunting, or sport can expose you and your family to significant civil and criminal liability if the firearms are misused, accessed by children, or are accidentally discharged and cause great bodily injury or death to another person.

For example, if you use a firearm in self-defense against a home intruder or other threat of deadly force, you will be questioned by the police as part of their investigation—and in some instances homeowners who shot an intruder have been charged with a crime or crimes and have even been sued by the home intruder or other attacker.

Services

The Member may receive phone consultations from the Provider Law Firm during regular, non-holiday office hours on an unlimited number of legal matters related to the Member’s Gun Ownership and Firearm Incidents. Consultations are available to the extent the Provider Law Firm deems it necessary to adequately advise the Member on the legal matter. One per subject/situation—up to 30 minutes per call.

The Member may consult with a Provider Attorney immediately after use of a firearm in a Firearm Incident on a 24 hour per day basis by calling the emergency number. The phone access provided is subject to the conditions imposed by the detaining or questioning authority, which may prevent a Provider Attorney from speaking with the Member on an immediate basis. 24/7 Emergency Access does not cover legal services or costs associated with the making, posting, or obtaining bond, bail, or other security required for release. Such legal services are available under the 25% Discount and such costs are the sole responsibility of the Covered Person. The 25% Discount only applies to the attorney fees and not to the bond, bail, or security, or any other fees charged by third parties.

The Member may have one National Firearms Act (NFA) Gun Trust prepared by the Provider Law Firm per Membership Year for a flat fee of $250—if an NFA Gun Trust is available in the Member's primary state of residence. An NFA Gun Trust is defined as a gun trust solely for weapons and devices as defined by the National Firearms Act. • Any other accompanying documents will be provided under the 25% Discount. • This Service is subject to a separate Attorney-Client contract, any required retainer fee or fee deposit, and costs. • The grantor of the NFA Gun Trust, the trustees, the beneficiaries, and owners of the qualifying guns, weapons, or devices that are the property of the NFA Gun Trust must be the Member or the Member’s Spouse. • Obtaining all state and federal approvals of the NFA Gun Trust, approval of the individuals who are part of the NFA Gun Trust, and execution and storage of the NFA Gun Trust will be the sole duty of the Member. • NFA Gun Trust Services are for basic trusts. Complex distributions of trust property, estate planning trusts, and any other type of gun trust or a second NFA Gun Trust during the Membership Year will be provided under the 25% Discount.

If the Member is a named defendant in a Covered Lawsuit, the Member may receive up to 60 hours of trial defense in the Covered Lawsuit per Membership Year. A Covered Lawsuit is a civil lawsuit against the Member, or a criminal prosecution of the Member that is filed in a state or federal court and that arises from a Firearm Incident involving a Member who is in a physical location in which the Member is legally permitted to possess and carry (concealed or open) the Member’s firearm at the time of the Firearm Incident. The Member must have an active Individual & Family Legal Plan and an active Gun Owner’s Supplement at the time of the Firearm Incident—both of which must be in good standing at the time of the Firearm Incident. These 60 hours of trial defense services include up to 20 hours of Pretrial Time and 40 hours of Trial Time. Pretrial Time is defined as time spent by the Provider Law Firm in defense of a Covered Lawsuit prior to the date of jury selection—or, if it’s a nonjury trial, time spent prior to the date of opening statements. For example, Pretrial Time includes phone calls, mediations, settlement conferences, pretrial scheduling conferences with the judge or a court or arbitration administrator, discovery (written discovery, depositions), and preparation of pleadings, and briefs—including motions for summary judgment or other early dismissal. Trial Time is defined as time spent by the Provider Law Firm in defense of a Covered Lawsuit, beginning on the date of jury selection—or, if it’s a nonjury trial, beginning on the date of opening statements—and ending on the date of the jury verdict, bench decision (by the judge), or other conclusion of the trial. Trial Time is limited to 8 hours per day and may include Provider Law Firm time both in and out of the courtroom. The hours are available to use on all civil actions filed during a Membership Year. If more than one civil action is filed against a Member or the Member’s Spouse in a Membership Year, the unused hours remaining at the conclusion of each civil action may be used for any later civil action. Hours that are not used during the Membership Year expire and do not roll over to any later Membership Year. The Member must continue their membership while any civil action is pending to receive the Services.

The Member has the right to receive a 25% Discount off the Provider Law Firm's standard hourly rate for attorney fees on out-of-plan legal services (not covered by the Supplement) related to the Member’s Gun Ownership. The 25% Discount is available during the Eligibility Period unless the Supplement explicitly states that it is not available. The 25% Discount is not available for contingent fee/contingency fee matters or flat fee arrangements, which may be negotiated at a separate rate with the Provider Law Firm. The Member is responsible for paying court costs, fines, and related fees and expenses. Depending on the Member's legal needs, a retainer fee or fee deposit may be required by the Provider Law Firm prior to services being rendered under the 25% Discount. The Provider Law Firm is responsible for determining the amount of the retainer fee or fee deposit and any other anticipated costs.
