  • moving violations;

  • nonmoving violations;

  • licensing and loss of driving privileges;

  • criminal charges arising from motor vehicle accidents;

  • recovery of property damage claims to your rig or other commercial equipment or to your personal motor vehicle (up to 2.5 hours of attorney time and up to $2,000); and

  • recovery of personal injury damages from a motor vehicle accident (up to 2.5 hours of attorney time and up to $2,000).

A Covered Person may receive 2.5 hours of legal help from a provider attorney in each of the following situations: (1) the Covered Person is denied a driver's license; (2) the Covered Person's driver's license is cancelled, suspended, or revoked by the Department of Public Safety or Department of Motor Vehicles where a right to appeal is provided by statute; and (3) assistance is needed to reinstate or maintain a the Covered Person’s driver's license because of job-related or medical reasons.

A Covered Person has the right to receive a defense from the Provider Law Firm (in the court of original jurisdiction) when the Covered Person is driving any Licensed Motor Vehicle with the express consent and permission of the Licensed Motor Vehicle’s owner and the Covered Person is issued a noncriminal moving traffic ticket or citation for a violation arising from the use of the Licensed Motor Vehicle. This benefit is limited to up to two hours of attorney and legal assistant time spent in the negotiation and documentation of a deferred adjudication, plea agreement, probation, diversion, or other pretrial resolution that does not require an in-person appearance by the Provider Law Firm in court or in the prosecutor's office. Traffic tickets must be uploaded to the LegalFix Site and accessible to the Provider Law Firm within three (3) business days of the Covered Person receiving the ticket or citation.

A Covered Person has the right to receive a defense from the Provider Law Firm when the Covered Person is driving any Licensed Motor Vehicle with the express consent and permission of the Licensed Motor Vehicle’s owner and the Covered Person is issued a nonmoving traffic ticket or citation for an alleged violation on charges related to: • hours of service (HOS) violations • logbook violations • overloading or improper loading • driver's license violations • broken equipment (taillight) • lack of vehicle maintenance • lack of insurance/expired insurance • lack of registration/motor carrier authority • hazardous materials • load spillage • overweight • overlength • overheight • overwidth • expired inspection sticker • no medical card • no placard • permit violations • having a radar detector. This benefit is limited to up to two hours of attorney and legal assistant time spent in the negotiation and documentation of a deferred adjudication, plea agreement, probation, diversion, or other pretrial resolution that does not require an in-person appearance by the Provider Law Firm in court or in the prosecutor's office or in an administrative hearing.

A Covered Person has the right to receive help from the Provider Law Firm with collecting property damage losses of $2,000 or less for damages resulting from driving, riding in, or being struck by any motor vehicle or boat. This benefit is designed to help the Covered Person recover for minor property damage to their car or truck. The Covered Person may receive up to 2.5 hours of attorney time per claim. This benefit does not include the filing of a lawsuit.

A Covered Person has the right to receive help from the Provider Law Firm with collecting personal injury damage losses of $2,000 or less for injuries resulting from driving, riding in, or being struck by any motor vehicle or boat. The Member or Member's spouse may receive up to 2.5 hours of attorney time per claim. This benefit does not include the filing of a lawsuit.

• When Services Become Available. Services are available under this Commercial Driver’s Legal Plan beginning on the eleventh (11th) day after the date of enrollment. • Attorney Fees & Costs for Bail, Bond, or Other Security Not Covered. The Commercial Driver’s Legal Plan does not cover legal services or costs associated with the making, posting, or obtaining bond, bail, or other security required for release. Such legal services are available under the 25% off discount and such costs are the sole responsibility of the Covered Person. The 25% off discount only applies to the attorney fees and not to the bond, bail, or security, or any other fees charged by third parties. • Preexisting Conditions. Preexisting Conditions (violations, charges, claims, situations, acts, occurrences, conditions) are not covered under this Commercial Driver’s Legal Plan. • Hit-and-Run Charges. Matters involving hit-and-run-related charges, leaving the scene of an accident, or similar charges—or driving without a valid driver’s license—are not covered under this Commercial Driver’s Legal Plan. • DUI/DWI/Intoxication. Matters in which it is alleged the Covered Person is under the influence of or is impaired by alcohol, controlled substances, intoxicants, medicines, or chemicals—whether prescribed or not—are not covered under this Commercial Driver’s Legal Plan. • Involved in Crime. Matters in which the Covered Person committed or was involved in the commission of any crime under any municipal, state, or federal statute—except as otherwise provided in the Contract—are not covered under this Commercial Driver’s Legal Plan. • Frivolous Claims or Defenses Without Merit. Matters, claims, legal positions, legal actions, and legal strategies the Provider Law Firm determines, in its sole professional discretion, to be without merit or frivolous are not covered under this Commercial Driver’s Legal Plan. • Matters Previously Raised. Matters, claims, legal positions, legal actions, and legal strategies the Provider Law Firm determines have been raised an inordinate or unreasonable number of times without substantial change in circumstances are excluded and not covered under this Commercial Driver’s Legal Plan. • Appeals Not Included. Representation (defense) in matters involving moving traffic violations, nonmoving violations, and driver’s license points is provided in the court of original jurisdiction and does not include any appeal from the court of original jurisdiction. Representation (defense) is provided for the Covered Person if the Covered Person is properly licensed, insured, and is operating a Licensed Motor Vehicle with the express consent and permission of the Licensed Motor Vehicle’s owner and the Covered Person is issued a noncriminal moving traffic ticket or citation for a violation arising from the use of the Licensed Motor Vehicle. • Prompt Notice to Provider Law Firm. To be eligible for Services related to moving traffic tickets or citations, nonmoving violations, or driver’s license points, the Covered Person must call the Provider Law Firm for a related consultation within three (3) business days of receiving the ticket or citation. Traffic tickets or citations must be uploaded to the LegalFix Site and accessible to the Provider Law Firm within five (5) business days of the Covered Person receiving the ticket or citation.
