This rate includes costs like finance charges, insurance premiums related to the credit, and other credit-related add-on products. Some fees, such as application fees and participation fees, are also included, though there are exceptions.

  • Preservation of Legal Rights: Lenders cannot make you waive certain rights, nor can they force you into mandatory arbitration.

  • No Compulsory Allotments: Getting a loan shouldn't require a service member to create a voluntary military allotment.

  • No Prepayment Penalties: If you decide to pay off your loan early, lenders cannot penalize you for doing so.

What Loans Fall Under the MLA?

Post-2015, the Department of Defense (DoD) broadened the scope of credit products under the MLA. Now, many types of loans, including payday loans, certain student loans, and overdraft lines of credit, come under the act's purview. However, traditional overdraft services and loans meant to finance specific purchases like vehicles, which are secured by the item itself, aren't included. Credit card companies had until October 3, 2017, to adhere to these guidelines.

Loans Not Under MLA's Protection

Certain loans remain outside the MLA's boundaries. These include:

  • Residential mortgages, including refinancing, home equity loans, and reverse mortgages.

  • Loans specifically for purchasing a vehicle or personal property, provided the credit is secured by the item in question.

MLA's Impact on Loan Eligibility

If a loan doesn't comply with the MLA, can you be denied it due to your active duty status? In essence, yes. If a loan doesn't adhere to the 36% MAPR cap or other MLA provisions, providing such a loan could lead to penalties for the creditor under the MLA.
